On June 5, 2020, Governor Cuomo signed an Executive Order stating that “special education services and instruction … may be provided in person for the summer term in school districts.” School districts that provide in person instruction and services “must follow State and Federal guidance.”
If your child is entitled to receive summer services through their individualized education program (IEP), you should contact your school district to determine if your child’s services can and will be provided in person, and to confirm that the school district has a plan to follow all required safety guidance.
While this is great news for summer programs, and bodes well for the fall, at this time there is still no plan for how students will return to school in the fall and what that will look like. We encourage families to continue to have an open dialogue and work with their school districts during this time, and to keep notes of and keep their school district informed of any issues with services or instruction during this time.
We at the Cuddy Law Firm understand how frustrating and scary this time is for parents of special needs individuals, and we are here to help with any questions or issues you may have, and we hope everyone is staying safe.
