“On August 1, 2016 the New York State Department of Education issued a letter providing direction to the Local Educational Agencies (school districts).
In the case of a child whose behavior impedes the child’s learning or that of others, the individualized education program (IEP) Team must consider – and, when necessary to provide free appropriate public eduation (FAPE), include in the IEP – the use of POSITIVE behavioral interventions and supports, and other strategies, to address that behavior.
This is important when school districts seek to suspend and use other forms of discipline instead of the interventions outlined in the directive.
