Let Us Help You Secure Your Child’s Future

If you’re raising a child with disabilities, you know how much care they need and deserve. It’s tough to think about what happens when you’re gone.

At the Cuddy Law Firm, we can help you plan for your child’s future with a special needs trust. Having a trust ensures that your child receives appropriate public benefits throughout her life, no matter your income or assets.

These benefits can include Medicaid health coverage, Supplemental Security Income (SSI) and other government services.

Our special needs lawyers can help you navigate the system to protect your child for the long term, so you can focus on being in the present with her.

Special Needs Trust FAQs:

  • What does my child get with SSI?

  • What does Medicaid provide my child?

TEFRA/Katie Beckett and HCBS Waivers

There are other pathways to Medicaid outside of SSI.

The Tax Equity and Fiscal Responsibility Act (TEFRA)/Katie Beckett allows children with long-term disabilities to receive Medicaid services at home instead of an institution, and only counts the child’s income—not the parents’ income—for eligibility.

Home & Community Based Service (HCBS) waivers are available in most states as part of Medicaid, providing for long-term care in patients’ homes or home communities.

If your child receives services through these methods, a special needs trust can protect their access to assistance that makes a lasting difference in their lives.

The Cuddy Law Firm can help you decide which options are best for you and your family.
